Although this is not a First Amendment issue as there is no governmental action, it is just an example of the media picking up a frivolous lawsuit and oversensationalizing it. Lets make clear, the First Amendment issues were handled in the first trial and the students were victorious. They had a right to make a mock video. Without seeing the video, it is difficult to pass judgment on it completely, however, a Federal judge in Indianapolis (most likely conservative, republican) found that it was a valid exercise of free speech.
The lawsuit seems to me to be a stretch. The teacher was upset about the video and went to a lawyer. If you look at the allegations listed in the lawsuit, they are obviously manufactured to fit into a defamation claim. I doubt this teacher was thinking about a defamation claim when he went to see a lawyer.
